Hi, I've got a few threads spread out across the site dealing with several isues, all receiving excellent replys that are helping me alot. But this post is about a situation that worries me the most, My o/h owes around 8k on an abbey c/c, which we've been unable to keep up payments after being put out of work. I had been told rightly or wrongly (not by anyone on this site) that it's best to stop contact with the original lender and wait for the debt to be passed to a collector and negotiate payment with them, I don't know if this is the right thing to do, but it's the route that we have taken. But since finding this site I've read posts that say that the lender doesn't always use collectors and sometimes takes action through the court themselves. With a debt of 8k on a c/c is it likely that this will happen? also, the main worry is that we receive £88 a week c/t/c and around £30 child benefit. We have 2 children and this is our only source of income for which we have to use to pay other debts aswell as the usual utilitys ect. We know that until our work situation improves then the debt will never be paid off but we were hoping for damage limitation by at least paying something per month that we can afford, which right now isn't going to be alot. If it goes to a collector and they refuse an offer from us or the original lender takes us to court themselves, what is the worst that could happen to us? We rent and don't own, have no savings left anymore and are pretty much screwed. In your case the very worst that can happen is they go to court to get a CCJ against you. In your own interests turn up at court with proof of your income/child benefits each month and what you have to pay out each month. Then the court will set an amount you can easily afford to pay. In your case £1 a month token payment. But before it comes to that, send Abbey a CCA request and see if the debt is enforceable in the first place. You have a good chance that they won't be able to produce anything that is enforceable and puts you in far stronger position. If they can't produce an enforceable CCA, and they know that you know it's unenforceable, then it's highly unlikely they will attempt court action. What's the worst that can happen?
