Hope this doesn't mean the end for Marlin/Mortimer Clarke solicitors , as most Arrow stuff went through them before Weightmans. And to think Marlin/MC had just moved into a nice new office. Weightmans might not be so pleased with Arrow when they start to deal with this account. No paperwork after CCA request, then took me to court and discontinued (due to no paperwork). I even have a letter form Mortimer Clarke saying there is no paperwork but they are still trying to find it, that was over a year ago (CCA made nearly 2 years ago!). Some people say that the DCA now knows the A/C is in dispute and we shouldn't have to remind them but as you've had more demanding letters I'd send the A/C in dispute letter. Just a side not. don't bother sending I+E forms. Important info about Connaughts!!!!! Top A couple of month ago I wrote to my MP regarding Connaught Collections serving a SD on me. I have had a reply via my MP from John Fingleton the Chief Executive of OFT. Basically he says he is going to take my details for future action to be taken.He also expressed that OFT DO take action against Debt Collecting Companies who breech there guidance. If you have had a SD or been bullied by Connaught Collection please write a letter to your MP expressing there tactics and ask them to contact the OFT on your behalf. As the MP writes and gets an answer directly of the Chief Executive this should have some pull. The more complaints that get rasied OFT will have to act. Query A Subject Access Request is your request to the original creditor for details of any information they hold on your account. Many of the financial institutions have simply sent out a big bundle of copy statements, as that was reasonably easy for them to organise. However, that is not a solution which was set in stone, as you have discovered. What they have done here is to provide a computer printout of the transactions on the account, which may or may not be helpful to you. You need expert help in figuring out what it all means and I'm afraid I don't know for certain. The best guess is that if there are any values against the various transaction types then these could be charges? Did you specify in your request that you required copies of ALL records they held against your name? This could have included transcripts of any conversation you may have had with them, in person or by phone, as well as your agreement and so on. If you just sent a standard Subject Access Request they will have given a standard response. If you feel they have failed to provide what you asked for then write to them and say what they have missed. But, make sure you asked for it in your original request. Usually you would have requested a copy of your agreement in a CCA letter to whoever has been chasing you for payment, that's the first line of action to take. The banks know this and could have taken it this had already been dealt with. When I've looked at the Subject Access Request letters people send, I have felt that they do not go deep enough in asking for the information I know I would wish to see. My own request to the Hx, for my old credit card account, went on to ask for the transscripts and notes held on my account - in other words, ALL information they hold, not just the financial breakdown. Threatened with statutory demand for bankruptcy Top Can anyone please offer some advice? CapQuest (a debt recovery company) have sent me a statutory demand for bankruptcy for debts on two credits cards issued by Halifax Plc. Is there a way I can stop CapQuest proceeding with the bankruptcy petition? In accordance with the Consumer Credit Act 1974, I have sent CapQuest a letter requesting signed original copies of the agreements to which the debts relate. Is this sufficient ground to put the bankruptcy petition on hold? Any useful advice will be greatly appreciated. However in order to give you fuller reasons for obtaining the set aside it would be useful if you could answer the following questions: Are there any charges on these accounts e.g. late payment charges, overlimit charges? Have you received a default notice? Have you received a notice of assignment? Did you receive a letter before action informing you that a statutory demand would be issued? How much roughly is the amount claimed on the statutory demand? When were the accounts taken out? Are you a homeowner? __________________ HAVE YOU BEEN TREATED UNFAIRLY BY CREDITORS OR DCA's? YOU CAN NOW COMPLAIN TO THE OFT ABOUT THEIR CONDUCT UNDER THE CONSUMER PROTECTION FROM UNFAIR TRADING REGULATIONS 2008.
