| Aktiv Capital chasing 11 year old debt |
| I'm just wondering what I can do about this? I received a letter from Aktiv Capital today telling me I owe £xxx. I didn't recognise the name of the original creditor, and after speaking to them I found out it was from a store card that I got in 1997. I have made no payments for at least 9 years. This is the first letter I have had about this debt in about 8 years. However, they told me the last letter was sent to me in August 2007. I cannot remember receiving this, and I certainly made no payments/acknowledged debt. I was under the impression that this would be statute barred as it is well over 6 years old. However, Aktiv Capital maintain it's not and they will persue the debt anyway. Can they do this? What these muppets fail to realise is that the onus is on them to prove the debt exists....I'll rephrase that....they have to prove that it is enforcable....they can't unless you have paid anything or agreed in writing to within the last six years. The number of registered CAGgers is growing, ever more people are being helped and then staying around to help others, and the site is highly ranked in the search engines for so many relevant terms. I also predict that the DCAs will grow ever more desperate, and their behaviour towards innocent people will, if anything, get even worse. Which will bring more people to the search engines. I have received a letter from MBNA insisting that I make a payment to my account otherwise they will insist that I disclose personal assets and income. Could anyone tell me what this means? I wrote to MBNA on 4th October and asked that they freeze interest and charges on the account and suggest a fixed payment schedule for me. I also asked that they stop telephoning me. I had no reply until now. Even so I have received any number of telephone messages to my home and to my workplace but am wary of entering into any informal agreement with them. This has happened after a DCA 'Aegis' had harrassed me for weeks. Advice appreciated. Join Date: Dec 2006 Posts: 1,581 Re: Mbna firstly i would register with the mbna online a/c site then change all your phone nubers to 0's [using the correct format] that might stop all the calls. then i would fire of a telephone harrassment letter from the templates section and send it registered or recorded delivery. it might well be an idea to Subject Access Request them too, you must have lots of charges you can reclaim, that should put the A/c in dispute & stop them passing it around. lastly, NEVER talk on the phone, request all comms via letter good luck we are all with you. dx

What's the worst that can happen?
Hi, I've got a few threads spread out across the site dealing with several isues, all receiving excellent replys that are helping me alot. But this post is about a situation that worries me the most, My o/h owes around 8k on an abbey c/c, which we've been unable to keep up payments after being put out of work. I had been told rightly or wrongly (not by anyone on this site) that it's best to stop contact with the original lender and wait for the debt to be passed to a collector and negotiate payment with them, I don't know if this is the right thing to do, but it's the route that we have taken. But since finding this site I've read posts that say that the lender doesn't always use collectors and sometimes takes action through the court themselves. With a debt of 8k on a c/c is it likely that this will happen? also, the main worry is that we receive £88 a week c/t/c and around £30 child benefit. We have 2 children and this is our only source of income for which we have to use to pay other debts aswell as the usual utilitys ect. We know that until our work situation improves then the debt will never be paid off but we were hoping for damage limitation by at least paying something per month that we can afford, which right now isn't going to be alot. If it goes to a collector and they refuse an offer from us or the original lender takes us to court themselves, what is the worst that could happen to us? We rent and don't own, have no savings left anymore and are pretty much screwed. In your case the very worst that can happen is they go to court to get a CCJ against you. In your own interests turn up at court with proof of your income/child benefits each month and what you have to pay out each month. Then the court will set an amount you can easily afford to pay. In your case £1 a month token payment. But before it comes to that, send Abbey a CCA request and see if the debt is enforceable in the first place. You have a good chance that they won't be able to produce anything that is enforceable and puts you in far stronger position. If they can't produce an enforceable CCA, and they know that you know it's unenforceable, then it's highly unlikely they will attempt court action. Hi, yes, by all means send them the letter, and also send Lloyds this letter (marked N), DO NOT use your normal signature to sign it, better to print your name and enclose a £1 fee by way of postal order, whilst you are waiting for all that I would have a good read of the forum and gather information to help yourself do this, if it transpires that they do not have a properly executed agreement, then the ball really is in your court, you can set the amount you want to pay. If you have sent you income and expenditure, and can only afford token payments at present then it is not a case of them accepting your offer, rather a case of that is all they are going to get. Make the payments you offered regardless of what they threat. It usually takes a while before they stop interest, as they will try to get higher payments out of you in the interim, and it is also unlikely they will not default you.

Blair Oliver and Scott/Bank of Scotland ** Compensation awarded by FOS ** Top Hi Everyone, I'm new to the site (I have registered and had a good read) and just wanted to check a few things. I have 4 accounts with Bank of Scotland via Blair, Oliver and Scott, otherwise known in this house as Barmy Orrible and Stupid, and have had repeated problems with harassment, not replying to correspondence and all the other bullying tactics that have been discussed elsewhere. I'm currently pursuing a second complaint via the FOS - I won the first one. Despite the fact that there is an ongoing complaint, I am making the agreed payments and Citizen's Advice have intervened, I am still getting about 5 letters a week demanding that I phone them - which they have been repeatedly told I cannot do due to disability. I finally got really p***ed off this morning and reported them to trading standards. I hadn't previously considered disputing the debts, although no doubt there are horrendous charges especially on the two credit cards, because I consider that I do owe the money. However as I have no hope of ever going back to work and it will take about 300 years to clear at the current rate, all I now want is for them to go away and leave me alone. I've even had to change my (unlisted - how did they get it?) phone number. From what I've read I think I need to CCA them, but as barmy orrible and stupid are the same company as Bank of Scotland, who do I write to? Also, because of my circumstances I have asked for the debts to be written off, but of course they never reply. On the off chance that they have the documentation and actually send it to me in time, any suggestions on this point? Or any other ways of making them go away? At the rate we're going in another couple of years the compensation from the ombudsman will have cleared the debts anyway. You can put all four into one envelope and send it signed for recorded start timing them from when it is recieved, you can check this on royal mail track and trace. Hope this doesn't mean the end for Marlin/Mortimer Clarke solicitors , as most Arrow stuff went through them before Weightmans. And to think Marlin/MC had just moved into a nice new office. Weightmans might not be so pleased with Arrow when they start to deal with this account. No paperwork after CCA request, then took me to court and discontinued (due to no paperwork). Some people say that the DCA now knows the A/C is in dispute and we shouldn't have to remind them but as you've had more demanding letters I'd send the A/C in dispute letter. Important info about Connaughts!!!!! Top A couple of month ago I wrote to my MP regarding Connaught Collections serving a SD on me. I have had a reply via my MP from John Fingleton the Chief Executive of OFT. Basically he says he is going to take my details for future action to be taken.He also expressed that OFT DO take action against Debt Collecting Companies who breech there guidance. If you have had a SD or been bullied by Connaught Collection please write a letter to your MP expressing there tactics and ask them to contact the OFT on your behalf. As the MP writes and gets an answer directly of the Chief Executive this should have some pull. The more complaints that get rasied OFT will have to act. Query A Subject Access Request is your request to the original creditor for details of any information they hold on your account. Many of the financial institutions have simply sent out a big bundle of copy statements, as that was reasonably easy for them to organise. However, that is not a solution which was set in stone, as you have discovered. What they have done here is to provide a computer printout of the transactions on the account, which may or may not be helpful to you. You need expert help in figuring out what it all means and I'm afraid I don't know for certain. The best guess is that if there are any values against the various transaction types then these could be charges? Did you specify in your request that you required copies of ALL records they held against your name? This could have included transcripts of any conversation you may have had with them, in person or by phone, as well as your agreement and so on. If you just sent a standard Subject Access Request they will have given a standard response. If you feel they have failed to provide what you asked for then write to them and say what they have missed. But, make sure you asked for it in your original request. Usually you would have requested a copy of your agreement in a CCA letter to whoever has been chasing you for payment, that's the first line of action to take. The banks know this and could have taken it this had already been dealt with. When I've looked at the Subject Access Request letters people send, I have felt that they do not go deep enough in asking for the information I know I would wish to see. My own request to the Hx, for my old credit card account, went on to ask for the transscripts and notes held on my account - in other words, ALL information they hold, not just the financial breakdown. It may not be the answer you wanted, but they do seem to have provided the information they think you asked for. __________________ Be good to those who give you advice that helps - click the scales on the left to give them your thanks by way of a reputation credit. Threatened with statutory demand for bankruptcy Top Can anyone please offer some advice? CapQuest (a debt recovery company) have sent me a statutory demand for bankruptcy for debts on two credits cards issued by Halifax Plc. Is there a way I can stop CapQuest proceeding with the bankruptcy petition? In accordance with the Consumer Credit Act 1974, I have sent CapQuest a letter requesting signed original copies of the agreements to which the debts relate. Is this sufficient ground to put the bankruptcy petition on hold? Any useful advice will be greatly appreciated. Not being able to supply the credit agreement would be a reason to set aside the demand. However in order to give you fuller reasons for obtaining the set aside it would be useful if you could answer the following questions: Are there any charges on these accounts e.g. late payment charges, overlimit charges? Have you received a default notice? Have you received a notice of assignment? Did you receive a letter before action informing you that a statutory demand would be issued? How much roughly is the amount claimed on the statutory demand? When were the accounts taken out? Are you a homeowner? __________________ HAVE YOU BEEN TREATED UNFAIRLY BY CREDITORS OR DCA's? YOU CAN NOW COMPLAIN TO THE OFT ABOUT THEIR CONDUCT UNDER THE CONSUMER PROTECTION FROM UNFAIR TRADING REGULATIONS 2008. Hope this doesn't mean the end for Marlin/Mortimer Clarke solicitors , as most Arrow stuff went through them before Weightmans. And to think Marlin/MC had just moved into a nice new office. Weightmans might not be so pleased with Arrow when they start to deal with this account. No paperwork after CCA request, then took me to court and discontinued (due to no paperwork). I even have a letter form Mortimer Clarke saying there is no paperwork but they are still trying to find it, that was over a year ago (CCA made nearly 2 years ago!). Some people say that the DCA now knows the A/C is in dispute and we shouldn't have to remind them but as you've had more demanding letters I'd send the A/C in dispute letter. Just a side not. don't bother sending I+E forms. Important info about Connaughts!!!!! Top A couple of month ago I wrote to my MP regarding Connaught Collections serving a SD on me. I have had a reply via my MP from John Fingleton the Chief Executive of OFT. Basically he says he is going to take my details for future action to be taken.He also expressed that OFT DO take action against Debt Collecting Companies who breech there guidance. If you have had a SD or been bullied by Connaught Collection please write a letter to your MP expressing there tactics and ask them to contact the OFT on your behalf. As the MP writes and gets an answer directly of the Chief Executive this should have some pull. The more complaints that get rasied OFT will have to act. Query A Subject Access Request is your request to the original creditor for details of any information they hold on your account. Many of the financial institutions have simply sent out a big bundle of copy statements, as that was reasonably easy for them to organise. However, that is not a solution which was set in stone, as you have discovered. What they have done here is to provide a computer printout of the transactions on the account, which may or may not be helpful to you. You need expert help in figuring out what it all means and I'm afraid I don't know for certain. The best guess is that if there are any values against the various transaction types then these could be charges? Did you specify in your request that you required copies of ALL records they held against your name? This could have included transcripts of any conversation you may have had with them, in person or by phone, as well as your agreement and so on. If you just sent a standard Subject Access Request they will have given a standard response. If you feel they have failed to provide what you asked for then write to them and say what they have missed. But, make sure you asked for it in your original request. Usually you would have requested a copy of your agreement in a CCA letter to whoever has been chasing you for payment, that's the first line of action to take. The banks know this and could have taken it this had already been dealt with. When I've looked at the Subject Access Request letters people send, I have felt that they do not go deep enough in asking for the information I know I would wish to see. My own request to the Hx, for my old credit card account, went on to ask for the transscripts and notes held on my account - in other words, ALL information they hold, not just the financial breakdown.
